Landlords Stopped From Carrying Out Gas Safety Check
A trade company is reminding landlords of how important it is to carry out a gas safety check and to make sure their tenants agree to allow them access to carry out the necessary checks.
However a recent poll discovered that just under a half of landlords have not been allowed access to their properties for a mandatory annual gas safety check, and providing tenants with a copy of the certificate.
But the trade company’s recent survey found that 46 per cent of landlords have been barred from gaining access to carry out the necessary gas safety checks, making it virtually impossible to be legally compliant with the regulation.
The founder of the company, says: “Gas safety checks are not only a landlord’s legal obligation, but they are also imperative to ensuring the safety of the property and the tenants living there. Of course, sometimes it comes down to when is convenient, but when tenants continually deny access, it becomes a real problem.”
The trade company says it is planning to put forward a case to introduce a discretionary possession of a property because of a tenant’s irrational refusal to allow landlords access for the necessary safety inspections.
If this is introduced it will give landlords the essential authority when requesting access to carry out the inspections as required by law.
The company’s owner, says: “As the market evolves and the balance of power shifts towards the tenant, landlords are contacting us with increasingly complex legal challenges, which are likely to broaden in the future as the sector reforms. We already offer access injunctions to complete gas safety checks and are currently looking at what other support landlords may need.”
